Privacy Policy
Effective September 24, 2026
Scope
This Privacy Policy explains how Modern State Corporation, operating under the Modern State name, collects, uses, discloses, and protects personal information through the storefront, customer accounts, checkout, fulfillment, returns, customer support, and consented analytics. It does not cover independent websites linked from our store.
Information we collect
We collect information you provide, including your name, email address, phone number, account and verification information, order details, pickup selection, shipping or delivery address, recipient details, delivery instructions, return reasons, and evidence you choose to submit. We also keep records of policy acceptance, marketing choices, customer-support contacts, refunds, fraud-prevention decisions, and operational events needed to complete or audit an order.
Payment card fields are provided by Square. Modern State receives payment tokens, identifiers, status, and transaction evidence needed to complete and reconcile the purchase, but does not receive or store your full card number.
Essential cookies and browser storage support the cart, account security, fulfillment preferences, and saved privacy choices. If you choose Analytics, we collect bounded information such as pages viewed, clicks, category interest, checkout progress, session identifiers, and page-performance measurements. When configured, consented analytics is also sent to Google Analytics 4 with advertising storage and ad-personalization signals disabled. We do not intentionally include form entries, payment details, delivery addresses, or cart contents in behavior-analytics events.
How we use information
We use personal information to provide the storefront; verify inventory, prices, addresses, eligibility, and capacity; process payments; fulfill and track orders; manage accounts, returns, refunds, and customer requests; send transactional messages; record marketing consent; prevent fraud and abuse; secure and troubleshoot the service; comply with law; and maintain auditable business records.
Promotional email is optional and uses a separate unchecked choice. You may unsubscribe using the instructions in a marketing email. Transactional messages about an account, order, delivery, return, security event, or legal notice are not marketing messages.
Service providers and disclosures
We disclose only the information reasonably needed for a service to providers acting for us, including Square for catalog, orders, payments, refunds, and transaction records; OrderPRO for operational fulfillment and returns; Shippo and selected carriers for shipping, labels, and tracking; Stripe Tax when destination-tax calculation is enabled; Google Places for address suggestions when configured; Google Analytics 4 after analytics consent when configured; Resend for transactional email when enabled; hosting, database, security, and monitoring providers; and professional advisers supporting the business.
We may also disclose information to comply with law, protect customers or the business, investigate fraud or security incidents, or complete a merger, financing, reorganization, or sale subject to appropriate protections. We do not sell personal information for money or use it for cross-context behavioral advertising.
Retention and security
We retain information only for as long as reasonably needed for the purposes described above, including fulfillment, returns, accounting, tax, fraud prevention, dispute handling, legal obligations, and enforcement of agreements. Different records have different retention periods. Deletion requests do not require removal of records that must be retained or are needed to complete a transaction, protect security, or establish legal claims.
We use administrative, technical, and physical safeguards appropriate to the information and the size and nature of the business. No internet service can guarantee absolute security. If a covered security incident occurs, we will provide notices required by applicable law.
Your choices and requests
You can change analytics consent through Cookie settings in the footer and can unsubscribe from promotional email. Depending on applicable law, you may request access, correction, deletion, or a copy of certain personal information. Submit a request through the Contact page or by contacting either store. We may verify your identity and may deny or limit a request when the law permits or requires it.
Children
The online store is a general-audience service and is not directed to children under 13. We do not knowingly collect personal information online from a child under 13 without legally required parental consent. A parent or guardian who believes a child submitted information should contact us.
Changes and contact
We may update this policy prospectively and will publish the new effective date. Questions or privacy requests may be submitted through the Contact page, by calling 212-879-8076 or 212-831-8010, or by visiting either public store address listed above.
